Dear Friends,
After several emotional and stressful days following the release of the Commission on Elections’ resolution declaring Benjamin Dy as the winner of the 2007 Isabela gubernatorial race against incumbent Governor Grace Padaca, we can now take a moment to breathe a sigh of relief. The Dy camp’s motion for execution pending appeal was denied, allowing Gov. Padaca to continue as Isabela governor even as she appeals the COMELEC Second Division’s controversial decision.
In the course of five days, we, the friends and supporters of Gov. Padaca, have managed to raise funds for the publishing of a public statement declaring our support for her. The statement was signed by Filipinos from around the nation, including Isabelinos and overseas Filipinos. It was published in the Philippine Star last December 16, 2009 in a full page advertisement. A Tagalog version was also published in Abante the following day, December 17, 2009.
We also came out in support of Gov. Padaca on December 17 when hundreds of supporters from different groups held a peaceful rally in front of the Comelec office as the Second Division decided on the Dys’ motion for execution pending appeal. Among those who came were Gov. Padaca’s fellow Kaya Natin! Champion for Good Governance, Pampanga Gov. Ed “Among Ed” Panlilio, himself awaiting the COMELEC 2nd Division’s decision on the recount case in his province; Atty. Roberto “Bobby” Laurel, president of the Lyceum of the Philippines University where Gov. Padaca graduated as magna cum laude; Arch. Adonis Simpao, the official Liberal Party candidate going up against none other than Pres. Gloria Macapagal-Arroyo in Pampanga’s second congressional district; running priest Fr. Robert Reyes, and YouTube star Mae Paner a.k.a. Juana Change.
Since December 12, people had been generously giving various amounts to fund the publication of the statement and the rally through bank deposits and cash donations. Governor Padaca and the leaders of Kaya Natin! have always been a champion of transparency and accountability, and as such, we would like to practice what we preach. Below is the summary of the donations we have received from December 12-18, 2009 as well as the expenses we have incurred for this cause.

GRACE PADACA CHEATS THE PROVINCE OF ISABELA
On 09 July 2007, Benjamin G.Dy (“DY”) filed an Electoral Protest questioning the results of the election for the position of Governor in the Province of Isabela against Ma. Gracia Cielo Padaca. In his protest, DY assailed the results of the election in the One Thousand Four Hundred SeventyTwo (1,472) single/clustered precincts in the municipalities of Cordon, Echague, San Agustin, San Isidro, Delfin Albano, Tumauini, Ilagan, San Guillermo, Mallig, Quezon, Jones, Luna and Ramon. Meanwhile, Padaca filed her Answer with Counter-Protest where she assailed the results of the elections in One Thousand Two Hundred Eighty Seven (1,287) precincts in Cauayan City, Alicia, Angadanan, Aurora, Gamu, Ilagan, Luna, Reina Mercedes, San Guillermo and San Mariano.
DELAYS due to Padaca attended the early and speedy resolution of the case. These delays can be attributed to the various motions filed by Padaca’s expensive lawyers. In Gamu, a town controlled by a recognized warlord who is a known ally of Padaca, the ballot boxes turned over to COMELEC contained the ballots used during the SK/Barangay Elections. Thus, the revision was indefinitely suspended. However, instead of aggressively pursuing the investigation of the whereabouts of the ballots, Padaca chose to “keep quiet” and let valuable time pass by. This contributed to the delay until finally, COMELEC ruled the ballots to be lost. It did not help that the Municipal Treasurer of Gamu refused to cooperate with COMELEC.
Thus, after months of waiting, the parties finally presented evidence. At this point, Padaca once more tried to delay the case by her insistence on presenting witnesses to allegedly corroborate her assertions of fraud. On several instances, Padaca asked for postponements on flimsy grounds that her lawyer was sick or that the witnesses could not be located. In a final desperate attempt to delay the proceedings, Padaca requested that COMELEC summon the Board of Election Inspectors from 31 precincts. Having seen through the delaying tactics of Padaca, COMELEC denied her motions and ordered the submission of her evidence.
At this point, Padaca was able to delay the disposition of the case for almost EIGHT (8) months.
FRAUD clearly attended the 2007 elections. The Resolution of COMELEC shows that BEN DY won by a margin of more than 1,000 votes. We can only speculate as to how this margin could have been increased had there been a chance to recount all ballots in the province.
Written by One Person – Illegal/Invalid
This was arrived at by COMELEC by invalidating ballots that were clearly written by one person. An examination of the ballots from the contested precincts show that in one precinct there would be groups of ballots that were clearly accomplished by only one person. This means, only one person would write/vote using several ballots. These ballots would be filled out by one person even prior to the start of the voting during the elections. Then, these ballots would be inserted in the ballot boxes and made part of the counting. This was consistently revealed in the Municipalities of Delfin Albano, Echague, Cordon, Jones, Tumauini and Ilagan. Not surprisingly, in these instances, the votes were made in favor of Padaca.
Written by Two Persons – Illegal/Invalid
In other cases, the ballots show that insertions (written by another person/ written by two) were made in the space for Governor with the name “Grace” or “Padaca” being written. These ballots were also invalidated by COMELEC. To make matters worse, there were ballots that show different colored inks were used to write the name of Padaca in the space for Governor.
Marked Ballots – Illegal/Invalid
There were also instances where the ballots were marked by the voters, a prevalent practice to identify whether the voters (who were given money) in fact voted for the person/candidate. These markings can be usually seen in the space for party-list. In other instances, the ballots from one precinct will show that several voters voted for the senators in the exactly same order. These are considered as Marked Ballots by COMELEC.
The fact that election fraud was perpetuated during the elections is an understatement. Clearly, the real choice/will of the people could not be Padaca as the ballots do not show that the real voters accomplished and voted for Padaca as their Governor. However, what is clear from the examination of the ballots conducted by COMELEC is that in a province-wide operation, DY was cheated by PADACA from what was a legitimate victory.
Gov Grace tama na pang lilinlang mo sa buong sambayanan. ang linaw linaw na wala pang order ang COMELEC sa motion ni Gov Ben.
At bakit kaya hindi napansin ng lawyer ni Gov Grace at pati mismo si Gov Grace (na perfectionist ha) na yung nag notario verification nya ay not good standing sa IBP??? Delaying tactic na naman ba ito Gov????
TRUTH BE TOLD THAT THE MOTION FOR IMMEDIATE ISSUANCE OF WRIT OF EXECUTION BY GOV. BENJAMIN G. DY HAS NOT BEEN DENIED OF REJECTED.

Benjamin Dy(Protestant) vs. Ma. Gracia Cielo Padaca(Protestee)
ORDER
When this case was called for hearing this morning on protestant’s Motion for Immediate Issuance of Writ of Execution, Atty. Maria Bernadette V. Sardillo appeared as counsel for the protestant while Atty. Maria Donna Guia Lerona-Camitan appeared as counsel for the protestee.
Atty. Sardillo manifested that with the protestee’s filing of her Opposition to protestant’s Motion for Immediate Issuance of Writ of Execution, the pending incident is now submitted for resolution. Moreover, she alleged that the protestant has not yet received a copy of protestee’s Motion for Reconsideration (MR), and that protestant will submit within the day his Manifestation showing that upon verification of the records of the Commission (Second Division), it appears that the Verification attached to the MR was defective as it was not properly notarized in accordance with the Notarial Law.
Atty. Camitan averred that protestee reserves the right to file her comment or opposition to protestant’s Manifestation, if so filed. Further, she undertakes to furnish protestant a copy of protestee’s MR within the day.
The parties interposed their manifestations and counter-manifestations on matters pending before the Divisions.
WHEREFORE, as agreed upon by both counsel, the protestee is hereby DIRECTED to furnish protestant a copy of her Motion for Reconsideration, through personal service, within the day. On the other hand, protestant is hereby given a period of three (3) days from receipt of protestee’s MR within which to file his comment or opposition thereto. Subsequently, protestee is given two (2) days from receipt of protestant’s Opposition within to file her Reply thereto. Thereafter, with or without said pleadings, the pending incidents shall be deemed submitted for resolution without further arguments.
SO ORDERED.
